Terms of Service

Welcome to BidBuraq ("we", "our", or "us"). These Terms of Service govern your use of our car and bike rental bidding platform, website, and mobile applications in Bangladesh. By creating an account, placing a bid, or using our services, you agree to these terms.

1. Agreement & Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use BidBuraq. By using our services, you represent that you meet these requirements and that you will comply with all applicable laws in Bangladesh. If you are using BidBuraq on behalf of a business, you represent that you have authority to bind that entity to these terms.

2. Services Description

BidBuraq operates an online platform that connects customers seeking car or bike rentals with vehicle owners and drivers. We facilitate competitive bidding, bookings, and payments. We act as an intermediary—we do not own the vehicles listed, employ drivers as our staff, or guarantee the condition, availability, or conduct of third parties. Your rental agreement is between you and the vehicle owner or driver; we help facilitate the transaction.

3. Accounts & Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current information when registering and keep it updated. You may not share your account, transfer it, or use it for any illegal or unauthorized purpose. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to users or the platform.

4. Bidding & Bookings

When you place a bid on a vehicle, you are making an offer to rent that vehicle on the stated terms (dates, location, etc.). The highest bid when the auction ends typically wins, subject to our confirmation and the owner's acceptance. By bidding, you agree to complete the rental and pay the winning amount if you win. We reserve the right to cancel bids or bookings that we suspect are fraudulent, in bad faith, or otherwise inconsistent with these terms.

Bookings are subject to vehicle availability and driver/owner acceptance. We do not guarantee that any specific vehicle or trip will be available.

5. Payments, Fees & Cancellations

You agree to pay all amounts due for winning bids, rentals, and any applicable fees (e.g. taxes, fuel, insurance add-ons) as displayed before you confirm. We accept payment methods such as bKash, Nagad, Rocket, bank transfer, and cards, as made available on our platform. Failure to pay may result in suspension of your account and collection action.

Cancellation policies vary by booking. You may withdraw a bid before the auction ends at no cost. After winning, a short grace period may apply for free cancellation; later cancellations may incur a fee as stated at the time of booking. We will always show cancellation terms clearly before you confirm.

6. User Conduct

You agree not to:

• Use BidBuraq for any illegal purpose or in violation of any laws.
• Harass, abuse, or harm other users, drivers, or our staff.
• Submit false information, fake bids, or manipulate our systems.
• Scrape, copy, or reverse-engineer our platform without permission.
• Interfere with the security or operation of our services.
• Use another person's account or allow others to use yours.

We may suspend or terminate access for prohibited conduct and report illegal activity to authorities.

7. Intellectual Property

BidBuraq's name, logos, website, app, and all related content and technology are owned by us or our licensors. You may not copy, modify, or use our trademarks or content without our written permission. You retain ownership of content you submit (e.g. reviews, messages), but you grant us a license to use, display, and distribute it in connection with our services.

8. Privacy

Your use of BidBuraq is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described there.

9. Disclaimers & Limitation of Liability

Disclaimer of warranties. Our platform and services are provided "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. We disclaim all warranties, express or implied, to the fullest extent permitted by law.

Limitation of liability. To the maximum extent permitted by law, BidBuraq and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of our services, even if we have been advised of the possibility of such damages. Our total liability for any claims related to these terms or the services shall not exceed the amount you paid to us in the twelve (12) months before the claim arose, or one hundred (100) US dollars, whichever is greater. Some jurisdictions do not allow these limitations; where they apply, our liability will be limited to the maximum permitted by law.

We are not liable for the acts, omissions, or conduct of vehicle owners, drivers, or other users. Disputes about vehicle condition, accidents, or rentals are primarily between you and the relevant party; we may assist with resolution but are not responsible for their actions.

10. Indemnification

You agree to indemnify, defend, and hold harmless BidBuraq, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your violation of these terms or any law; (c) your violation of any third-party right; or (d) any dispute between you and another user, driver, or vehicle owner in connection with a booking or rental.

11. Disputes & Governing Law

These terms are governed by the laws of Bangladesh. Any dispute arising out of or relating to these terms or our services shall first be attempted to be resolved through good-faith negotiation. If that fails, the dispute may be submitted to the courts of Dhaka, Bangladesh, and you consent to the exclusive jurisdiction of those courts.

Nothing in these terms prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

12. Changes to Terms

We may update these Terms of Service from time to time. We will post the revised terms on this page and update the "Last updated" date. Material changes may also be communicated via email or in-app notice where appropriate. Your continued use of BidBuraq after changes take effect constitutes acceptance of the updated terms. If you do not agree, you must stop using our services.
